“Shared Sweeps $100,000 Giveaway II” (the “Sweepstakes”)

OFFICIAL RULES

NO PURCHASE OR DONATION NECESSARY TO ENTER OR WIN.  A PURCHASE, DONATION OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

  1. SWEEPSTAKES DATES: The Sweepstakes begins at 12:00:00 a.m. Pacific Standard Time (“PST”) on February 1, 2024 and ends at 11:59:59 p.m. PST on April 30, 2024 (the “Sweepstakes Period”). For purposes of these Official Rules, all times are given in Pacific Time.

 

  1. ELIGIBILITY: Open to legal permanent United States residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older (except as follows: nineteen (19) years of age or older in Alabama and Nebraska; twenty-one (21) years of age or older in Mississippi) as of the date of entry, and to legal residents of Canada (excluding Quebec), who have reached the legal age of majority in their jurisdiction of residence as of the date of entry (the “Entrant”).  Current and past employees, officers and directors of Shared Sweeps LLC (the “Sponsor”), its subsidiaries, affiliates, related companies, of business entities and non-profit organizations with which Sponsor has engaged in a business relationship relative to offering this Sweepstakes (“participating business entities” and “participating non-profit organizations”; as set forth at www.sharedsweeps.com), or of advertising/promotion agencies of any of the preceding, and any others engaged in the development, production, execution or distribution of the Sweepstakes, including, but not limited to, National Sweepstakes Company, LLC (the “Independent Administrator”) (collectively referred to herein as “Sweepstakes Entities”) as well as their immediate family members (spouses, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of such employees, officers and directors are not eligible to participate. All federal, state, provincial/territorial, and local laws and regulations apply. Sweepstakes is void in Quebec, outside of the fifty (50) United States and the District of Columbia and Canada and wherever else prohibited or restricted by law.

 

  1. TO ENTER:  Sponsor will offer the Sweepstakes in conjunction with certain participating business entities and non-profit organizations as identified on digital and print materials advertising the Sweepstakes.  As discussed below, Sponsor is offering only ONE Sweepstakes prize in conjunction with all such participating business entities and non-profit organizations. For a list of participating business entities and non-profit organizations visit www.sharedsweeps.com.

 

There are six (6) ways to receive entries into this Sweepstakes:

 

  1. VIA PURCHASE AT A PARTICIPATING BUSINESS ENTITY’S WEBSITE: A participating business entity will post/advertise their qualifying product on their website along with the time frame in which the purchase of the qualifying product will be available during the Sweepstakes Period.  The participating business entity may not make the qualifying product available for purchase to receive entries during the entire Sweepstakes Period.

Visit a participating business entity‘s website and make a purchase of any qualifying product during the timeframe specified (as indicated on that business entity‘s website) to receive one (1) entry, two entries or three (3) entries depending on the participating business entity for every $1USD (For residents of Canada, $1.34 CAD) spent on such qualifying purchase (including tax, shipping and handling fees).**  Entrant will need to provide all of the required information in order to complete a purchase. Upon completion of the purchase, Entrant will automatically receive the entry or entries for each $1USD spent on a qualifying purchase at the website. Coupons and discounts may be used in conjunction with qualifying purchase as per participating business entity’s policy, with the understanding that doing so will reduce the total amount of the qualifying purchase and result in the receipt of fewer entries than if coupon/discount were not used. Should participating business entity’s website allow for refunds and/or returns and an Entrant qualifies for a refund and/or return and claims it as per such participating business entity’s refund/return policy, any entries received via such purchase will be cancelled.

**Each participating business entity will indicate on its website whether the purchase of any qualifying product during the timeframe specified (as indicated on that business entity‘s website) will result in receipt of one (1) entry,  two (2) entries or three (3) entries for every $1 USD/$1.34 CAD as set forth above. Be sure to check the website BEFORE the purchase of any qualifying product during the timeframe specified to determine whether such purchase will result in receipt of one (1), two (2) or three (3) entries for every $1 USD/$1.34 CAD as Sponsor reserves the right without further notification of any kind to modify the number of entries for every $1 USD/$1.34 CAD in conjunction with the purchase of a qualifying product during the corresponding timeframe. (However, in all cases, the purchase of a qualifying product on a participating business entity’s website during the corresponding timeframe will result in receipt of at least one [1] entry for every $1 USD/$1.34 CAD.)

  1. VIA DONATION TO A PARTICIPATING NON-PROFIT ORGANIZATION VIA ITS WEBSITE:  Visit www.sharedsweeps.com/donate (the “Website) or a participating non-profit organization‘s website and make a donation to receive one (1) entry for every $1USD donated.  Entrant will need to provide all of the required information in order to complete a donation. Upon completion of the donation, Entrant will automatically receive the entry or entries for each $1USD donated during the Sweepstakes Period.  Sponsor makes no representation, warranty or guarantee of any kind that Entrant will receive a tax deduction or other charitable benefit in conjunction with donation to participating non-profit organization; the availability of any such charitable benefit is a matter to be resolved solely between Entrant as the donor and the participating non-profit organization as the donee. (An Entrant may therefore wish to consult with his/her accountant or other tax professional before seeking to claim any such charitable benefit in conjunction with making a donation.) SPONSOR IS NOT ACTING AS A PROFESSIONAL FUNDRAISER OR CHARITABLE SOLICITOR.    

 

  1. VIA REGISTRATION AT PARTICIPATING BUSINESS ENTITY’S WEBSITE: Complete the online entry form with all required information, to receive two (2) entries. (For clarity, entry via registration at business entity’s/non-profit organization’s website is separate and apart from provision of required information to complete qualifying purchase/donation as per A or B above.)

 

If a purchase or donation is made other than via the participating business entity’s/non-profit organization’s website, no entry will be received in conjunction therewith.

For entry via purchase or donation, no entry will be received if (a) the corresponding transaction is void and not accepted for any reason (e.g., unauthorized use of credit card) or (b) the participating business entity or non-profit organization (as the case may be) does not record all necessary information so as to issue entry/entries in conjunction with the corresponding transaction; Sponsor, Independent Administrator, participating business entities and participating non-profit organizations shall not have any liability in conjunction with entry/entries not being received for such reasons.

 

  1. VIA DOWNLOAD OF A BUSINESS/NON-PROFIT APP: Download a participating business entity or non-profits app and complete any requirement for registration to receive two (2) entries into the Sweepstakes.  The participating business entity or non-profit app can be downloaded using IOS or Android. Partial or incomplete downloads will not be accepted.

 

  1. VIA SUBSCRITPION DEALS: Visit an organization’s website and sign up for a subscription to receive monthly entries.  Entrant will need to provide all of the required information as requested in order to submit and complete the subscription. Upon completion of the subscription, Entrant will automatically receive one (1) times the entries for the first month, two (2) times the entries for the second month, three (3) times the entries for the third month and so on and so forth until the maximum of six (6) times the entries for six months.  If an Entrant requests a refund, the refund and cancellation of entries will be determined based on the Sponsor’s refund policy.

 

  1. VIA PUSH NOTIFICATION: Upon downloading the participating business entity or non-profit app, sign up for push notifications via the app to receive two (2) entries into the Sweepstakes.

 

Normal Internet access and usage charges imposed by Entrants online service will apply. If Entrant participates from a mobile phone, such activity will be subject to the charges pursuant to their wireless service provider’s rate plan. Entrant further understands that by participating via mobile phone, if they are a potential prize winner, the Sponsor may contact them via mobile phone, which will be subject to the charges pursuant to their wireless service provider’s rate plan. Please consult wireless service provider for more information. Entrants are solely responsible for any related equipment and Internet access charges, if any.

 

  1. ALTERNATE METHOD OF ENTRY (“AMOE”): To receive an entry into the Sweepstakes without making a qualifying purchase from a participating business entity or a donation to a participating non-profit organization: Visit https://bit.ly/3vN9vLx and complete the online entry form in its entirety and click “Submit” to receive thirty-eight (38) entries per submission during the Sweepstakes Period.  There is a limit of one (1) submission per calendar day.

 

Regardless of method of entry, entries submitted or completed by anyone other than the Entrant are void.

Regardless of the method of entry, there is a limit of ten thousand (10,000) entries per Entrant during the Sweepstakes Period.

Regardless of the method of entry, Sponsor, Independent Administrator, participating business entities and participating non-profit organizations are NOT responsible for any entry that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.

Without limitation, Sponsor reserves the right in their sole discretion to disqualify any Entrant whose social media account that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Sweepstakes or any other person or entity; does not comply with these Official Rules; or if Sponsor receives notification about any potential infringements or breaches of law or any other reason set forth herein. Sponsor and/or Independent Administrator will not verify receipt of entries.

All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.  In the event of a dispute regarding the identity of the person who submitted an entry the entry will be deemed submitted by the Authorized Account Holder (defined below) of the e-mail address connected with the email account from which the purchase/donation/registration associated with the entry was made. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by the Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. An Entrant may be requested to provide Sponsor with proof that the Entrant is the Authorized Account Holder of the email address associated with the entry. For entry via methods A, B, or C, any acknowledgment of receipt of purchase/donation/registration is not otherwise binding upon Sponsor, participating business entity/non-profit organization or Independent Administrator under any legal theory. Any attempt by any Entrant to enter this Sweepstakes using multiple/different accounts or any other methods may void the Entrant’s entries and may result in disqualification, at the sole discretion of Sponsor. Use of any automated system to participate in the Sweepstakes is prohibited and may result in disqualification. The Sweepstakes Entities are not responsible for any entry that is lost, late, misdirected or  undeliverable, whether due to system errors, omissions, interruptions, deletions, defects, delays in operation or transmissions or any other reason, theft or destruction or failures, faulty transmissions or other telecommunication malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, technical malfunctions, or otherwise. Proof of submission of entry does not constitute proof of receipt of same or proof of entry. Late entries or entries sent via any other method than those stated above will not be accepted.

 

  1. WINNING/ODDS: There will be one (1) random drawing held on or about May 3, 2024 in which one (1) grand prize winner (the “Grand Prize Winner”) will be selected from among all eligible entries received during the Sweepstakes For the avoidance of doubt, eligible entries received from all participating business entities and non-profit organizations (along with eligible entries submitted via method D) will be included in the same random drawing; and, accordingly, at most one (1) participating business entity or non-profit organization will yield the winning entry.  Odds of winning the grand prize (“Grand Prize”) will depend upon the total number of eligible entries received from all participating business entities and non-profit organizations (along with eligible entries submitted via method D) during the Sweepstakes Period. The random drawing will be conducted by the Independent Administrator, whose decisions are based upon its sole discretion and interpretation of these Official Rules and are final and binding in all respects.

 

  1.  PRIZE:

GRAND PRIZE:  One (1) $100,000USD Grand Prize to be awarded.  Ultimately, the Grand Prize that will be awarded will be determined by the Sponsor. The participating business entity will be able to advertise their own Grand Prize.  The Grand Prize to be awarded will be determined based on the business entity that received the entry unless it is an AMOE entry and the Grand Prize that will be awarded will be determined by the Sponsor. Grand Prize cannot be substituted, assigned or transferred, except at Sponsor’s sole discretion or as otherwise provided herein.  Grand Prize Winner is required to comply with any and all applicable federal, state, provincial and local laws, rules and regulations. The Grand Prize Winner is solely responsible for any expenses not listed herein related to the acceptance and use of the Grand Prize.   No more than the one (1) Grand Prize as set forth in these Official Rules will be awarded.

 

  1.  PRIZE CLAIM:  Grand Prize Winner will be notified via a contact source provided at the time of registration (at the discretion of the Independent Administrator) within five (5) business days of the drawing date. The potential Grand Prize Winner must sign and return to the Independent Administrator an affidavit of eligibility/release of liability/publicity release in the form provided by the Independent Administrator (the “Release”) and IRS form W-9 (US Residents) in order to claim the Grand Prize (collectively, the “Required Documents”) within the time frame indicated in the Notification. If the potential Grand Prize Winner fails to sign and return the Required Documents within the required time period, the potential Grand Prize Winner forfeits his/her right to the Grand Prize and an alternate Grand Prize Winner may be selected at random from among all remaining non-winning eligible entries received from all participating business entities and non-profit organizations (along with all remaining eligible entries submitted via method D) during the Sweepstakes Period, at the discretion of the Independent Administrator and time permitting. If the potential winner is a resident of Canada, they will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question, failing which they will be disqualified, and another potential Grand Prize Winner may be randomly selected from among the remaining non-winning eligible entries received from all participating business entities and non-profit organizations (along with all remaining eligible entries submitted via method D) during the Sweepstakes Period, at the discretion of the Independent Administrator and time permitting.

 

The Grand Prize is taxable as income as required by applicable law, and the Grand Prize Winner is solely responsible for any taxes on the Grand Prize, including, but not limited to all applicable federal, state, provincial and local taxes. The Independent Administrator must report the value of the Grand Prize to the IRS in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the IRS in the form of a Form 1099.  In the event it is deemed during the verification process that the potential Grand Prize Winner does not have a unique, personal and valid social security number for Sponsor (or any party acting on its behalf) to report the tax liability associated with acceptance of the Grand Prize, the potential Grand Prize Winner will be disqualified and another potential Grand Prize Winner may be randomly selected from among the remaining non-winning eligible entries received from all participating business entities and non-profit organizations (along with all remaining eligible entries submitted via method D)  during the Sweepstakes Period, at the discretion of the Independent Administrator and time permitting.  Valid social security numbers will be determined by IRS requirements.

 

  1. GENERAL: By participating in this Sweepstakes, each Entrant agrees:  [a]  to abide by and be bound by these Official Rules and the decisions of the Sponsor and Independent Administrator which shall be final in all respects relating to the Sweepstakes, including without limitation the interpretation of these Official Rules; [b] to release, discharge and hold harmless Sponsor, its subsidiaries, affiliates, related companies; participating business entities and non-profit organizations; advertising/promotion agencies of any of the preceding, and any others engaged in the development, production, execution or distribution of the Sweepstakes, including Independent Administrator; and the officers, directors, employees, agents, representatives, shareholders, successors and assigns of any of the above; from any and all injuries, liability, losses, damages, rights, claims and actions of any kind including liability for personal injury or death resulting from his/her participation in the Sweepstakes or acceptance, use or misuse of the prize; and  [c] if the prize winner, to the use of his/her name, voice, image, likenesses, city/state/province/territory of residence, publicly available biographical information and other indicia of his/her persona for advertising, publicity and promotional purposes by Sponsor and its designees (including participating business entities and participating non-profit organizations) without further notice or compensation (unless prohibited by law) and, except where prohibited and without further compensation, to execute specific consent to such use if asked to do so.

 

Sponsor, its subsidiaries, affiliates, related companies; participating business entities and non-profit organizations; advertising/promotion agencies of any of the preceding, and any others engaged in the development, production, execution or distribution of the Sweepstakes, including Independent Administrator, and each of their respective officers, directors, employees, agents, representatives, shareholders, successors and assigns are not responsible and shall not be liable for; [a] electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction; [b] unauthorized access to or alterations of entry materials; [c] technical, network, telephone equipment, electronic, computer, hardware or software malfunctions; or [d] limitations of any kind or inaccurate transmissions of or failure to receive information by Sponsor (or participating business entity/non-profit organization) on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. Sponsor, participating business entities, participating non-profit organizations and/or Independent Administrator are not responsible for lost, late, incomplete, incorrect, damaged, misdirected, or illegible entries or any condition caused by events beyond the control of the Sponsor (and/or Independent Administrator and/or any participating business entity and/or any participating non-profit organization) that may cause the Sweepstakes to be disrupted or corrupted.   Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning the prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices  or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, any participating business entity, any participating non-profit organization or Independent Administrator.  Entries which contain false information, are incomplete, inaccurate or are otherwise forged, defective, or made outside authorized channels, including those which have failed due to malfunction or failure of phones, phone lines, telephone systems or networks, server, providers, computer equipment, software or any combination thereof of any kind, any human error or otherwise, shall be void. Without limitation, the preceding includes sham purchase and donation transactions.

 

CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES OR DEFRAUD SPONSOR, PARTICIPATING BUSINESS ENTITIES, NON-PROFIT ORGANIZATIONS OR INDEPENDENT ADMINISTRATOR IN CONJUNCTION THEREWITH MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AS WELL AS PARTICIPATING BUSINESS ENTITIES, PARTICIPATING NON-PROFIT ORGANIZATIONS AND INDPENDENT ADMINISTRATOR EACH RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S/INDEPENDENT ADMINISTRATOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.  If, for any reason whatsoever, this Sweepstakes, in Sponsor’s sole opinion, is not capable of running as planned, including, but not limited to, by reason of infection by computer virus, tampering, fraud, technical failures, or any other cause which, in the Sponsor’s sole judgment, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Sweepstakes and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. Notice of such action will be posted on the websites of all participating business entities and non-profit organizations. All federal, state, provincial/territorial, and local regulations apply.  TO THE FULLEST EXTENT PERMITTED BY LAW, ENTRANTS AGREE THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND/OR CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES OR THE PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK, USA WITHOUT REGARD TO PRINCIPLES OF CONFLICTS OF LAW; (2) ANY DISPUTE/CLAIM/CAUSE OF ACTION MUST BE BROUGHT EXCLUSIVELY IN NEW YORK STATE COURT SITUATED IN ROCHESTER, NEW YORK USA OR UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF NEW YORK SITUATED IN ROCHESTER, NEW YORK USA, WITH ENTRANT AGREEING TO THE PERSONAL JURISDICTION OF SUCH COURTS AND WAIVING ANY CLAIM OF CHANGE OF VENUE, FORUM NONCONVENIENS OR THE LIKE; (3) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES, IF ANY, BUT IN NO EVENT WILL ENTRANT BE ENTITLED TO RECEIVE ATTORNEYS’ FEES OR BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ANY FORM OF INJUNCTIVE OR EQUITABLE RELIEF.

 

  1.   PRIVACY POLICY: By entering the Sweepstakes, each Entrant consents to the collection, use and distribution of his or her personal information by the Sponsor for the purposes of implementing, administering and fulfilling this Sweepstakes and, if consent is given at the time of entry.  Sponsor will use all personal information in accordance with its Privacy Policy, available here: www.sharedsweeps.com/privacy/. Businesses’ and non-profits may have different policies and practices, and questions with respect to those should be directed to the business or non-profit, rather than to the Sponsor.

  1. OFFICIAL RULES:   Visit the Website of any participating business entity or non-profit organization for a copy of these Official Rules during the Sweepstakes Period.

This Sweepstakes shall not be published without written permission by Sponsor.
